Having been on two juries and foreman of one, my experience has scared the $h!t out of me ever having to put my life in their hands. The lack of critical thinking, logic and basic understanding of the law was frightening.

From AP at this hour: A conflicted jury in San Diego County found former NFL star Kellen Winslow II guilty of raping a 58-year-old homeless woman in 2018, but remained deadlocked on six additional felonies; the jurors did not rule out coming to an agreement on those 6.

It was a lazy move by the prosecution to try all the cases in one trial.

The public will get a bad result. He'll be out in time to attack other defenseless elderly ladies.
Lazy prosecutors played this like an easy multiple scratch-off ticket. 5 highly impactfull crimes diluting each other.

Not so sure. Hung jury on five counts enables the prosecution to retry. Since they have one conviction in the bank, they’re playing with house money in the next trial.

Why so? I'm just curious.
This is a very interesting case.
because he is clueless.

the prosecutor always wants to try as many cases at the same time as possible. if you're on a jury do you think you're more likely convicted if you hear that the guy did it multiple times? you think you're likely to believe that the old woman was senile and hallucinating if multiple old women said the same thing?

the defendant always wants the counts separated as much as possible, no matter what the crime.

Exact opposite: it’s a smart move. Testimony after Testimony of rapes and more rapes makes it hard to believe he’s innocent.

1 person testifies defense can argue wrong person or even consent.

But multiple people coming forward is powerful. I’d bet my left nut the defense moved to have each count tried separately.

Exactly the FEDs are famous for over charging and hoping to get a compromise verdict from a jury. It often works, ie see Conrad Black, the jury acquits on most charges but the guilty side gets a bone or two throne their way. It is an infamous prosecutor move when they have a weak case.

Just asking: 5 eyewitness victims is a weak case? And not dubious characters? Reporting to police that's somewhat timely? How does this effect the reluctance of victims to come forward?

It might be if it is 5 witnesses to 5 rapes and the charges get severed into 1 witness for 1 rape in 5 cases seen by 5 different juries.

it depends on how reliable the eye witnesses are. Are the crack addicts or nuns? Can they pick out the accused or did they just describe some of his characteristics? Eye witness evidence is often unreliable from what I have read.
