Well I know for a fact that you need a federal court order to pull deleted email/messages from an account without the users permission. Yes you can file a normal subpoena with your local magistrate, but you need the other parties written consent to pull these. If they don't sign that subpoena you cant pull them, no?
We pulled the text messages from my Verizon account with a court order, with the state attorney's paperwork and signature. Ownership is the key, I owned by account and gave consent. If the university owns the account and gives consent they can be pulled. Just like emails, if Ohio State owns the email server, first by federal law they should have redundancy (which I'm sure the investigator tried so hard to pull up). If not they should have ownership of at least the transmission and acceptance on that account.
